Legislative requirements

Under the current Work Health & Safety (WHS) legislation the person in control of a business or undertaking (PCBU) has an obligation to assess the risks all off hazardous materials within the workplace and to develop a materials register prior to refurbishment or demolition works commencing on a commercial job in the A.C.T. The materials register will provide all recommendations for the safe removal or management of all hazardous materials noted on site.

Prior to any refurbishment of demolition works on properties within the A.C.T it is a legislative requirement to have a residential asbestos assessment on the property. A licensed asbestos assessor must be engaged to perform this type of assessment to identify as far as reasonably practicable all asbestos containing materials on site & to provide recommendations on the safe removal of management of all items identified to contain asbestos.

In the A.C.T under the current WHS legislation all commercial buildings built prior to 2003 must have a current asbestos management plan (ASMP) with an asbestos register updated regularly. The PCBU must ensure that the ASMP is updated and kept on site for the use of all contractors and employees likely to come in contact with ACM whilst performing their workplace duties on site. It will provide PCBUs with all current legislation and recommendations for all ACM within the workplace.
